Mr. MORAN of Virginia (for himself, Mr. TOM DAVIS of Virginia, Mr. WOLF, Mr. HOYER, Mr. SCHROCK, Mrs. MORELLA, Mr. WYNN, Mrs. JO ANN DAVIS of Virginia, Mr. FORBES, Mr. SCOTT, Mr. GOODLATTE, Mr. BOUCHER, Mr. CANTOR, Ms. NORTON, and Mr. GOODE) introduced the following bill; which was referred to the Committee on Armed Services, and in addition to the Committee on Resources, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned

A BILL

To authorize the Secretary of Defense to establish a memorial on the Arlington Naval Annex to the victims of the terrorist attack on the Pentagon.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. MEMORIAL TO VICTIMS OF ATTACK ON THE PENTAGON.

(a) IN GENERAL- The Secretary of Defense shall establish and maintain a memorial dedicated to the men and women who lost their lives as a result of the terrorist attack on the Pentagon on September 11, 2001.

(b) LOCATION- The memorial shall be established on the Arlington Naval Annex, a parcel of Federal land located in Arlington County, Virginia, which is subject to transfer to the administrative jurisdiction of the Secretary of the Army under section 2881 of the Military Construction Authorization Act for Fiscal Year 2000 (division B of Public Law 106-65; 113 Stat. 879).

(c) COMPLIANCE WITH STANDARDS FOR COMMEMORATIVE WORKS- The siting, design, and construction of the memorial shall be in accordance with sections 7 and 8 of the Commemorative Works Act (40 U.S.C. 1007-1008). The memorial shall not be subject to any other requirements of that Act.

SEC. 2. FUNDING.

(a) IN GENERAL- The Secretary of Defense may accept funds from private sources to design, construct, and maintain the memorial.

(b) ACCOUNT IN TREASURY- The Secretary shall deposit amounts that are accepted under this section into a separate account in the Treasury established for such purpose. Amounts deposited into the account shall be available for expenditure without further appropriation to carry out this Act.

(c) AUTHORIZATION OF APPROPRIATIONS- To the extent necessary to supplement amounts received from private sources under this section, there are authorized to be appropriated to the Secretary of Defense such sums as may be necessary for carrying out this Act.
